Humble Autos Terms and Conditions

These Terms and Conditions (Terms) govern your use of the Humble Autos mobile application, website, and related services (collectively, the Service).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. About Humble Autos

Humble Autos (we, us, or our) operates a platform that allows users to browse vehicles, request inspections, arrange test drives, make enquiries, and access other services related to vehicle purchases and ownership.

We may work with licensed dealers, importers, and service providers to fulfil your requests.

2. Eligibility

By using the Service, you confirm that:

• You are at least 18 years old or have reached the age of legal majority in your jurisdiction; and
• You have the legal capacity to enter into a binding agreement; and
• You will use the Service in compliance with these Terms and all applicable laws.

If you are using the Service on behalf of a company or another legal entity, you represent that you are authorised to bind that entity to these Terms.

3. Your Account

3.1 Registration

To use certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials secure;
• Promptly update your information if it changes.

You are responsible for all activities that occur under your account. If you suspect unauthorised use, you must notify us as soon as possible at [email protected]

3.2 Account Deletion

You can delete your Humble Autos account at any time from within the app:

1. Open the app and ensure you are signed in.
2. Go to your Profile section.
3. Open Account / Account Settings.
4. Tap Delete Account and follow the confirmation steps.

Once confirmed, your account will be deactivated and scheduled for deletion. We may retain certain information where required by law, to prevent fraud, or for legitimate record-keeping purposes.

4. Use of the Service

4.1 Licence

We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service solely for your own personal, non-commercial purposes (or internal business purposes if applicable), in accordance with these Terms.

4.2 Prohibited Uses

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Attempt to hack, reverse engineer, decompile, or interfere with the Services security or operation;
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our express permission;
• Upload, transmit, or share any content that is illegal, abusive, defamatory, fraudulent, misleading, or infringes any third-party rights;
• Impersonate any person or entity or misrepresent your relationship with us or any third party.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

5. Vehicle Listings, Pricing, and Availability

The Service displays information about vehicles, including photos, descriptions, prices, and availability. You acknowledge and agree that:

• Listings are for information and invitation to treat only and do not constitute a binding offer;
• Vehicle availability, specifications, and prices may change at any time without notice;
• Certain information is provided by dealers or third parties and, while we aim to keep it accurate, we cannot guarantee that it is always complete, up to date, or error-free;
• Any purchase, booking, inspection, test drive, financing, or related arrangement may be subject to additional terms between you and the relevant dealer, seller, or finance partner.

You should verify important details (such as condition, documentation, mileage, and legal status of the vehicle) before making any purchase decision.

6. Bookings, Deposits, and Payments

Where the Service allows you to:

• Request inspections or test drives;
• Reserve vehicles;
• Pay deposits or fees;
• Apply for financing or related services;

you understand that:

• We may use third-party payment processors or finance partners;
• We do not store your full card or bank details;
• Additional terms of the relevant third party may apply;
• Confirmation of a booking or deposit does not guarantee the completion of a sale; issues such as failed inspections, missing documentation, or legal constraints may affect the transaction.

Any disputes related to vehicle condition, transfer of ownership, or financing terms are primarily between you and the relevant dealer, seller, or finance provider, although we may assist in good faith where appropriate.

7. User Content

If the Service allows you to submit content (e.g., messages, reviews, inquiries, documents):

• You retain ownership of your content;
• You grant us a worldwide, non-exclusive, royalty-free licence to use, store, reproduce, display, and distribute that content as necessary to operate and improve the Service, and to communicate with you and relevant partners (for example, sharing your enquiry with a dealer);
• You confirm that you have the right to share this content and that it does not infringe any third-party rights or violate any law.

We may remove or restrict content that, in our reasonable opinion, violates these Terms or is otherwise inappropriate.

8. Privacy

Our use of your personal data is governed by our Privacy Policy, which explains what information we collect, how we use it, and your rights.

By using the Service, you acknowledge that you have read and understood the Privacy Policy.

9. Intellectual Property

All rights, title, and interest in and to the Service (including but not limited to software, design, text, images, logos, trademarks, and other content) are owned by us or our licensors.

Except as expressly allowed in these Terms, you may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

Humble Autos and any related logos, slogans, or trade dress are our trademarks or service marks. You may not use them without our permission.

The Service may contain links or integrations with third-party websites, apps, or services (including payment providers, finance partners, mapping services, or social media).

We do not control and are not responsible for these third-party services. Your use of them is subject to their own terms and privacy policies. We recommend reviewing those carefully before using them.

11. Disclaimers

To the maximum extent permitted by law:

• The Service is provided on an as is and as available basis;
• We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components;
• We make no warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information.

Vehicle images, descriptions, and data are for general informational purposes. You are responsible for independently verifying any information that is important to your decision to view, reserve, or purchase a vehicle.

12. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages;
• Our total aggregate liability for any claims arising out of or related to the Service or these Terms shall not exceed the greater of:
• (a) the amount you have paid to us (if any) for the use of the Service in the twelve (12) months preceding the event giving rise to the claim; or
• (b) a nominal amount as permitted by applicable law.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by law.

13. Indemnity

You agree to indemnify, defend, and hold harmless Humble Autos, its directors, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to:

• Your use of the Service;
• Your violation of these Terms; or
• Your infringement of any third-party rights.
